In discussing whether legal systems are necessarily coercive, legal philosophers usually appeal to thought experiments involving angels or other morally driven beings who need no coercion to organise their social lives. Such appeals have invited criticism. Critics have not only challenged the relevance of such thought experiments to our understanding of legal systems; they have also argued that, contrary to the intuitions of most legal philosophers, the ‘man on the Clapham Omnibus’ would not hold that there is law in a (...) society of angels because the view that law is necessarily coercive ‘enjoys widespread support among laypersons’. This is obviously an empirical claim. Critics, however, never systematically polled the ‘man on the Clapham Omnibus’. We boarded that bus. Corporate governance is increasingly becoming an issue of global concern, not least because we are more and more living in a corporate world that transcends international boundaries. The main purpose and motivation of this study is to determine how the international community should motivate businesses in fostering exemplary corporate governance, therefore eliminating obstacles to ethically exemplary behavior. The empirical approach utilized here has been applied to 161 businesses, both listed and over-the-counter (OTC) companies, with the results indicating that ethical considerations, (...) corporate governance and organizational performance are inextricably linked and, to an extent, demonstrably proportional. This study also indicates a major finding that family management is a significant mediating variable of the ethical considerations of corporate governance and organizational performance. Finally, this study has developed an operational model of ethical considerations of corporate governance as a consultancy aid for businesses that wish to implement and/or boost their performance in respect to corporate governance. In this paper a semantics for dynamic predicate logic is developed that uses sequence valued assignments. This semantics is compared with the usual relational semantics for dynamic predicate logic: it is shown that the most important intuitions of the usual semantics are preserved. Then it is shown that the refined semantics reflects out intuitions about information growth. Some other issues in dynamic semantics are formulated and discussed in terms of the new sequence semantics.

Companies do have ethical responsibility and are not protected by limited liability from the consequences of their actions. A company's record and the preception of its ethics affect its reputation and ensure long term success or failure.The financial community has a history of placing moral considerations above legal or opportunistic expedients. But we are often exposed to moral dangers and the dangers of contamination are increasing. Deregulation and the technological revolution are sharpening ethical conflicts.

Ever since they were first published, the works of Bernard Mandeville have met with a few careful readers as well as with a larger number of stupid or unscrupulous assailants. Both classes are faithfully recorded at the end of F. B. Kaye's splendid edition of The Fable of the Bees , which has helped to revive interest in Mandeville, and which has moulded the current estimate of his ideas: the treatment of Mandeville in such a work as Basil Willey's (...) Eighteenth Century Background is confessedly based almost entirely on Kaye. My purpose in this paper is to suggest some modifications of the account given by Kaye, and to make claims for Mandeville's importance in one particular field, the relation of ethics to politics. Tradition in either of its two senses—the act of handing on , and what is handed on—is a particular instance of a law of human existence that men live in dependence on one another and by the processes of giving and receiving. So a sociologist can write, ‘If we are able to speak of real tradition, we must find the past spontaneously taken into account as the meaning of the present, without any discontinuity of social time, and without any consideration (...) of the past as irrelevant’ . ‘If democracy’, wrote Chesterton, ‘means that I give a man a vote even though he is my chauffeur, tradition means that I give a man a vote even though he is my great-great-grandfather’. What is handed on, however, is not existence of a purely biological kind, to remain always what it has been or to change very slowly over a space of aeons. Except in primitive tribes even tradition is not simply passed on as something static and timeless, and it is received by men who, though themselves in time, are not totally time-bound or restricted by what they receive. They believe themselves to be capable of significant action which is more than the repetition and reproduction of what has gone before. They are able to grasp a span of time and to call it history; they believe themselves to have a history, and they write history. (shrink)

The development of the dynamic semantics of natural languagehas put issues of variable control on the agenda of formal semantics. Inthis paper we regard variables as names for stacks of values and makeexplicit several control actions as push and pop actions on stacks. Weapply this idea both to static and dynamic languages and compare theirfinite variable hierarchies, i.e., the relation between the number ofvariable stacks that is available and the expressivity of the language.This can be compared in natural languages with (...) relating the number ofpronouns available to the expressivity of the language.The results are obtained using techniques from static and dynamic modeltheory: model theoretic games, transition systems and bisimulation. Curio’s six lictors with laureled fasces (Cic. Att. 10.4.9) are best explained by his holding command in 49 BC not as Caesar’s legatus, but pro praetore with imperium nominally in his own right, granted (‘extra-constitutionally’) by Caesar directly, without vote of Senate and People.

The Battle of Drepana in 249 b.c. marks the most significant defeat of Roman naval forces at the hands of their Carthaginian opponents during the First Punic War. Attempting to take the Punic fleet in the harbour of Drepana by surprise, the consul P. Claudius Pulcher sailed with his ships from Lilybaeum about midnight, and reached Drepana at dawn. Yet, owing to swift and level-headed counter-measures taken by the Punic commander, Adherbal, the unfolding fight – partly in the harbour, mostly (...) off the shore – turned into a fiasco for the Romans. The consul got away; he returned to Rome, where the Senate instructed him to appoint a dictator. How soon he returned, and by what route, is the question. (shrink)

It is generally believed that Polybios mistook L. Iunius Pullus (cos. 249) for one of the consuls of 248 B. C. The internal evidence of Polybios’ narrative shows clearly that he knew the correct year of Iunius’ consulship, and inadvertently created a false impression of the date by structuring his account so as to tell the story of the Roman siege of Lilybaeum without interruption, from its inception in 250 to Claudius Pulcher’s defeat at Drepana in the following year. This (...) narrative objective led him to postpone the paragraph (1.52.4-5) detailing the Roman reaction to the disastrous siege operations of 250 and the consular elections for 249 until after his account of Drepana, without considering how such an arrangement could mislead readers two millenia hence. It is argued that (1) the alleged violation of the auspices by both the Consuls of 249 B. C. did in fact occur and (2) resulted in separate prosecutions directed at each of them; (3) the name ‘Pullius’, reported for one of the plebeian Tribunes that prosecuted P. Claudius Pulcher, is probably authentic; (4) the cognomen of L. Iunius Pullus is not spun out the violation of the auspices attributed to him and his colleague; and (5) the cognomen ‘Pulcher’, first (...) born by the Consul of 249, may actually derive from his drowning of the Chickens. Recently in this journal, R. Shaw-Smith suggested reading ‘citra Kal. Ian.’: ‘circa, implying that the consul died either before or after 1st January, will not do.’ Will the example of citra at Aug. 43.4, adduced by Shaw-Smith ] in support of the meaning ‘ before’?

Contrary to the widely held view that the Roman-Carthaginian naval encounter Polybios reports at 1.21.9-11 was separate from the one off Mylae (260 BC) told at length right afterwards (1.23), the battle at the ‘Cape of Italy’ is in fact - as suspected by some scholars long ago - identical with the one at Mylae. However, far from mistaking (as has been suggested) Philinos’ account of the latter for a separate engagement, Polybios knowingly and deliberately told the battle of Mylae (...) twice: first in a brief summary, stripped of all detail, to illustrate how the Roman commander Cn. Scipio Asina (cos. 260) and his Punic counterpart, Hannibal, were both guilty of equally inappropriate acts of recklessness; then for a second time in detail and in its proper chronological place. Compositional considerations prompted this approach: to wait with the moralizing parallel until after his full account of Mylae (preceded in turn by the long technical disquisition on the Roman boarding bridges) would spoil the effect, and Polybios chose to place it immediately after Asina’s capture.
